Terms of Service

1. The ListingLaunch service

ListingLaunch provides tools for capturing property media, submitting listing-media orders, coordinating production, purchasing credits and subscriptions, requesting enhancements, tracking order status, and receiving completed deliverables. Features and availability may change as the service develops.

2. Eligibility and accounts

You must be at least 18 years old and able to enter a binding agreement. You agree to provide accurate account information, protect your credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account except to the extent caused by ListingLaunch.

You may not share staff or administrative access, attempt to bypass role restrictions, interfere with service security, reverse engineer protected components, upload malicious material, or use ListingLaunch for unlawful or deceptive activity.

3. Orders, capture, and delivery

You are responsible for lawful property access, obtaining any owner or occupant permissions, preparing the property, following capture guidance, and providing complete and accurate order information. The quality of finished media depends on source capture, lighting, property condition, device compatibility, and the services purchased.

Quoted delivery times are targets, not guarantees, and begin only after ListingLaunch receives a complete order and all required source media. Complex orders, revisions, technical failures, holidays, unusually high volume, unsafe or unlawful requests, or incomplete files may affect delivery.

You must inspect delivered media before publishing it. Notify support promptly if files are missing, assigned to the wrong order, corrupted, or materially inconsistent with the purchased service.

4. Credits, subscriptions, and payments

Prices are displayed in U.S. dollars unless stated otherwise. Applicable taxes may be added. Stripe processes payments and manages payment methods, invoices, and subscription billing.

Credits

Listing credits and enhancement credits are service units used only within ListingLaunch. They are not currency, have no cash value, may not be transferred or resold, and are not redeemable for cash except where required by law. The app shows the credit cost before an eligible order is submitted.

Subscriptions

Subscriptions renew automatically at the disclosed interval and price until canceled. Plan benefits and monthly credits are associated with the subscribed account. You can manage eligible subscription settings through the Stripe billing portal. Cancellation generally prevents future renewal and does not automatically refund the current billing period.

Refunds and disputes

Except where required by law, completed services and consumed credits are non-refundable. If you believe a charge is incorrect or a service was not provided, contact support before initiating a payment dispute so we can investigate the order and transaction.

5. Beta service

During beta testing, ListingLaunch may contain defects, interrupted workflows, incomplete features, changing interfaces, or limited support capacity. You agree to maintain copies of important source media and not rely on ListingLaunch as the only storage location. We may limit participation, pause features, reset test data, or end beta access.

6. Your content and permissions

You retain ownership of photos, media, text, and other content you submit, subject to third-party rights. You grant ListingLaunch and its service providers a nonexclusive, worldwide license to host, copy, process, modify, transmit, display, and create requested deliverables from that content solely to operate, secure, support, and improve the service and fulfill your orders.

You represent that you have the rights and permissions needed to submit the content and authorize the requested processing. You may not submit content that violates privacy, intellectual-property, contractual, property-access, or other legal rights.

ListingLaunch retains rights in the application, website, production systems, branding, templates, and service content, excluding your submitted content and deliverables to the extent otherwise agreed.

7. Artificial intelligence and enhancements

Some features may use automated or AI-assisted processing, including description generation and visual enhancements. Outputs can contain errors or unsuitable details. You are responsible for reviewing MLS copy, marketing claims, virtual staging, twilight conversions, and other generated content for accuracy, disclosure requirements, and compliance before publication.

8. Suspension and termination

We may restrict or terminate access when reasonably necessary to protect users, providers, property media, payment systems, or ListingLaunch; respond to violations or legal requests; prevent fraud; or discontinue the service. You may stop using the service and request account deletion, subject to retention described in the Privacy Policy.

9. Disclaimers and limitation of liability

To the maximum extent permitted by law, ListingLaunch is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee uninterrupted operation, a particular sales result, MLS acceptance, or that every output will be error-free.

To the maximum extent permitted by law, ListingLaunch will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost opportunities, or loss of data arising from use of the service. ListingLaunch’s aggregate liability for a claim will not exceed the amount you paid ListingLaunch for the service giving rise to the claim during the three months before the event, unless applicable law requires otherwise.

10. Changes

We may modify these terms as the service changes. Updated terms will be posted with a revised effective date. Material changes may receive additional notice. Continued use after the effective date means you accept the updated terms where permitted by law.
